RULES OF ELECTION
SYRO MALABAR CATHOLIC CHURCH LONDON

KAIKARAN means, a member of the parish, elected by the Pothuyogam or Co-ordination committee and confirmed and appointed by the local hierarch, or directly appointed by him under special circumstances, to help the parish priest in keeping and administering parish properties and incomes, for the parish according to the norms of ecclesiastical law and in conducting the programmes and affairs of the parish and to work in cooperation with the parish priest in exercising pastoral ministry and administering financial matters of the parish.

THE CO ORDINATION COMMITTEE means, a body, consisting of those elected by the General Body members and others duly elected or nominated or ex-officio as members and approved by the Coordinator.

SECTION 1. ELECTION:
The election to the Co-ordination Committee shall be as follows:
1.1. The meeting for the election must start and end with prayer.
1.2. Allow the first thirty minutes for the members to introduce themselves. A Bio data on each member can be published and distributed to the members if it is possible.
1.3. Members of the General Body Meeting
1.3.1. Coordinator for the three diocese in London
1.3.2. Chaplain of the Diocese
1.3.3. Coordination Committee Members
1.3.4. Kaikkars from the Holy Mass centres in the Diocese
1.3.4.1. Only two Kaikkars are allowed from a Holy Mass centre, one should be a male and the other should be a female.
1.3.4.2. These Kaikkars must be selected by the Pothuyogam of each Holy Mass centre.
1.3.4.3. Either the Coordinator or a member from the coordination committee nominated by the coordinator must be present at the Parish elections.
1.3.4.3.1. The nominated member should not be the member of the same parish.
1.3.4.3.2. This rule is prepared and implemented due to the special circumstance in the United Kingdom.
1.4. The Co-coordinator will be the Election Commissioner and the Chaplain of the Diocese will Chair the meeting.
1.5. An election presiding officer will be appointed by the existing co-ordination committee. He/She will be a member of the co-ordination committee, who does not belong to the Diocese where the election is conducted.
1.6. The Presiding Officer must conduct the election and should sign the form with the names of the newly elected representatives of the Diocese.
1.6.1. This Form has to be counter signed by the Election Commissioner and the Chaplain of the Diocese.
1.7. The existing Co-ordination committee members present in the General Body meeting has no right of vote or cannot be re elected as the representative unless he/she is a Kaikkaran of a Holy Mass centre belongs to that Diocese.
1.8. The General Body Meeting in each Diocese has to elect two members from the Kaikkars present in the meeting. These two representatives will be representing the Syro Malabar faithful in the respective diocese.
1.9. As far as possible elections shall be by consensus and if not, by the majority of the members present.
1.10. If there is more than one candidate the election must be conducted by secret balloting.
1.11. The Ballots must be counted by the Presiding Officer in front of the General Body Meeting.
1.12. No other members apart from the General Body members are allowed during the election procedure.
1.13. Complaints if any, about the elections shall be submitted to the Election Commissioner. All complaints will be considered and a decision will be made by the Co-ordination Committee.
1.14. The Presiding Officer must keep an election log book, which may be used to log all the events during the General Body Meeting. It must contain the names of members present and of any late comers.
1.15. Those who have any of the disqualifications mentioned in the Disqualification Section of this document cannot be members of the Co-ordination committee.
1.16. The Accountant and Sacristan (Devalaya Sushrushi) can attend the meeting of the General Body Meeting if so required to explain the accounts of the parish and to make a report of the meeting and other such matters; however, they shall not be members of General Body Meeting.
1.17. The term of office of the representatives to the Co-ordination Committee shall be one year, unless it is extended by the local hierarch, in special circumstances.
1.18. Any member absenting himself from three consecutive meetings without sufficient reason and excuse in the judgment of the Chaplain shall lose his/her membership in the Co-ordination Committee.
1.19. If a member suffers from any of the disqualifications mentioned in Disqualification Section of this document, but known only after becoming a member, or suffers a disqualification during the term of membership, he ceases to be a member of the Co-ordination Committee and the matter must be brought to the attention of the Co-ordination Committee by the Chairman. And if there is a dispute, the matter shall be referred to the administrative tribunal assigned by the Co-ordination committee.
1.20. Vacancies arising in the Co-ordination Committee are to be filled within three months by election or nomination or ex-officio according to the nature of the vacant seat.
1.21. If no members from the Knanaya Ethinic community are elected to the coordination committee, the coordinator can nominate two members from the Knanaya community to the coordination committee. Preferably one male and a female.
1.22. The Co-ordination Committee shall exercise the following functions and duties:
1.22.1. To impart leadership by initiating active and constructive roles with a view to foster, facilitate and to promote the spiritual, social, cultural, catechetical, pastoral, developmental, charitable activities and youth formation in the Diocese, having due regard to the religious atmosphere of the parish;
1.22.2. To pass the monthly, quarterly, half yearly statements of accounts.
1.22.3. To prepare annual accounts and budget and submit the same to the General Body Meeting;
1.22.4. To propose the programmes of feasts other than the major feasts and to help in conducting all such feasts;
1.22.5. To give guidelines on the general policies of administering the properties of the parish;
1.22.6. To constitute committees and to elect members to them as and when needed and to dissolve them;
1.22.7. To elect subject to eparchial statutes the Kaikkars;
1.22.8. To do, act or perform other duties specified and stipulated in the coordination committee such other duties as are directed to be performed, by the Co-ordinator.


SECTION 2

2. DISQUALIFICATIONS AND DISPUTES
2.1. The following persons shall not be entitled to become a member of any of the meetings of the General Body Meeting:
2.1.1. Those who stand publicly against the fundamental beliefs and principles of the Church, or
2.1.2. Those who are under ecclesiastical censure, or
2.1.3. Public sinners, or
2.1.4. Persons convicted of offences involving moral turpitude until reformed and certified by the parish priest, or
2.1.5. Persons who have defaulted annual paschal duties, or
2.1.6. Persons who are of unsound mind, or
2.1.7. Wilful defaulters of Church laws.
2.2. Persons drunken or under intoxication shall not be permitted to participate in the meeting of the General Body Meeting and Coordination Committee Meeting.
2.3. The Chairman of the corresponding meeting shall decide whether a person has to be excluded from a meeting of the General Body Meeting in accordance with these rules and the meeting shall be conducted according to the decision of the Chairman.
2.4. If any dispute arises as to whether a person is a member of the parish or whether he/she is entitled to exercise any right in a meeting of the General Body Meeting, the matter shall be settled as per SECTION 3 of this procedure rules.

SECTION 3
3. GENERAL AND TRANSITORY NORMS

3.1. All disputes, and complaints with regard to the conduct, proceedings, resolutions, decisions and actions taken or adopted by the General Body Meeting or Coordination Committee Meeting, shall be preferred by the aggrieved before the administrative Tribunal constituted by the Coordinator for such purpose, within 7 days from the date of such meeting. The Tribunal shall dispose off the dispute or complaint within 30 days from the receipt of such complaints. An appeal shall lie on the decision of the Tribunal to the Coordinator within 15 days of such decision of the Tribunal. The Coordinator shall dispose off the appeal as expeditiously as possible and his decision shall be final.
3.2. For grave reasons the coordinator can suspend a General Body Meeting or a Coordination Committee Meeting until further orders from him and make alternate arrangements according to his discretion for the administration of the parish.
3.3. Not withstanding anything herein contained, on account of the requirement, the coordinator, depending upon the special features, customs or practice may make necessary adaptations to these Rules and the Rules so adapted shall be binding on the Holy Mass centres within his responsibility
3.4. If any difficulty or doubt arises in giving effect to the provisions of these Rules in a particular Holy Mass centre, the coordinator may by order make such provision, not inconsistent with the purpose of these Rules, necessary or expedient for the removal of the difficulty or doubt.
3.5. No Christian faithful shall challenge these rules or matters arising there from in any legal proceeding other than recourse to coordination authorities.
3.6. These rules may be amended by the Coordination committee of the Syro Malabar Church.
3.7. If there is any custom or practice in any particular parish inconsistent with the Rules contained herein all such custom and practice will stand superseded as soon as these Rules come into force.
4. SECTION FOUR
4.1. Provision for amending rules
4.1.1. To amend a rule or decision taken by the coordination committee the coordination committee must follow the following procedures
4.1.1.1. All the members of the coordination committee should be present at the committee meeting.
4.1.1.2. At least seventy five percentages of the coordination committee members should agree with the amendments.
4.1.1.3. The final decision is left to the coordinator.
